NSW reserves the right to change these terms at any time by posting changes online without notice to you. It is your responsibility to review these terms regularly. Your continued use of this site after changes are posted constitutes your acceptance of the changed terms of use.
You agree to use the Site only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use of the Site. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within the Site. You shall not use the site to advertise or perform any commercial solicitation, including, without limitation, the solicitation of users to become subscribers of other on-line information services competitive with NSW.

NorthSeaWeather is committed to protecting your right to privacy as a user of our online services. The information you provide to us is held securely on NorthSeaWeather computers. The information we collect about you is used to enable us to maintain your account.
We do not store any financial data.
What data do we collect?
We will collect personal data as provided by you during the subscription process, which you agree to supply us as accurate. We do not monitor your use of the Internet but we do use cookie technology to monitor your use of the NorthSeaWeather site and your IP access address.
What do we do with it?
We use your personal details to maintain your account. We log and monitor access to the site to ensure login and password information is not being shared.
This information is not passed on to any third parties.
Refunds / Cancellation
Under the Distance Selling Regulations you have the right to cancel our services within seven working days. Instant access accounts are exempt from this as the service commences upon payment.
For all Service Cancellations made within the first seven days of service, a full refund will be made where no evidence exists to confirm that access was made to our subscripion services.
Where evidence exists to confirm access was made, a full refund minus the day rate for each days access will be made.
Refunds on 1 day access accounts. When subscribing to a 1 day access
account you will be transferred to PayPal to complete payment by Debit or Credit
Card. Once the transaction is satisfactorily completed your one day access
account will be activated on NorthSeaWeather. If the account has failed to
become active within 5 minutes a refund will be provided. We are unable to
provide a refund on this service if evidence exists that the account activated
and that you visited restricted pages within NorthSeaWeather subscription area.
Refunds for the service will be provided if evidence exists to confirm that the
account was activated and that you failed to gain access to NorthSeaWeather
subscribers area.
Refunds on all other accounts. Annual, monthly or weekly accounts
can be refunded for unused time. The refund rate will be calculated using the
lesser subscription type. For instance. The refund for an annual account
cancelled after two months would be calculated at the monthly rate for two
months and this amount subtracted from the Annual subscription rate.
Complaints
We will endeavour to satisfactorily address any complaints
within 7 working days, keeping you informed on any actions.

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, IN NO EVENT SHALL NSW'S OR ANY THIRD PARTY SUPPLIERS TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING ITS OWN NEGLIGENCE) OR UNDER ANY OTHER LEGAL THEORY (INCLUDING STRICT LIABILITY) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THIS SITE. THIS DOES NOT AFFECT ANY STATUTORY RIGHTS.
